Yes, Starfleet Security put him under house arrest and put an ankle monitor on Harry, but HE’S WEARING HIS COMBADGE the whole time. Earth must be where those who aren’t talented enough for shipboard assignments are posted. No one ever thinks once to scan for Harry’s combadge.
But then on the flipside, neither Tom nor Harry ever think to remove the combadge.
In all fairness, this is prior to the discovery that Changelings have infiltrated Earth or the Breen attack on San Francisco, but still that’s a pretty blatant oversight.
