What About the Federation’s Ban on Genetic Research?

In all fairness most of the information about the Federation’s ban on genetic research comes from later series and episodes. But when did retconning ever stop a nitpicker?

“Space Seed” (TOS S1 Ep22) establishes that a ban on genetic research was brought about on Earth due to the rise of Khan and the Eugenics Wars. “Doctor Bashir, I Presume?” (DS9 S5 Ep16) reveals the ban is still in effect and Bashir could be incarcerated for the crime. “Affliction,” (ENT S4 Ep15) states the ban was established “decades” before 2154.

Yet the Darwin Genetic Research Station is openly conducting genetic modification without a single comment from Picard or Pulaski. Did DGRS have special permission? Was it a Section 31 front? Is DGRS a non-Federation affiliated research facility established to skirt the genetic research ban? Nitpicking minds want to know.
